Unsure of how it works in Pennsylvania or the USA, but here in New Zealand we have something called the Consumer Guarantees Act which basically says that if you're unhappy with what you've bought and have a good reason to be so, then the seller must refund of replace the item. In your case, if whats happened to you happened here in New Zealand, you'd be able to get your old car back, or the dealer would get taken to court. There must be something similar in the US.
I would assume (but note I am not a lawyer and not familiar with US laws) that since you've returned the car with the scratch, and that you haven't signed any papers for the new cars (since its 30 days away), then the old car is still legally yours and you should be able to take it away, no matter what the dealer says, because you haven't traded it for anything yet. If I were you or your Mum, I'd seek legal advice - or go down to the dealer and say you no longer want a new car, and you want your old one back and that if it is not given back you will pursue the matter further. Also, once again I don't know if you have this in the US, but in NZ a lot of our car dealers belong to an organisation to say that they are reputable (Licensed Motor Vehicle Dealerships, or LMVD) and that if you are unhappy with them, you can take them to the organisation and they can possibly loose their LMVD license if they have brung the industry into disrepute or treaed a customer unfairly. If you do have something similar in the US, and the dealership you went to is a member (being a Ford dealer, its very likely they are) then you can also consider complaining to the bigger organisation. Clearly though they haven't treated you very well, the dealer guy sounds like a bit of a shark so just stand up for yourselves and don't let him/them bully you around - I'd say once he realises you're fully serious and willing to take things further, he'll back down.
Although your mum has signed papers for the new car, I'm assuming
a) this was for the blue car that you took back, in which case the papers I don't think will be valid anymore, or
b) they're for the car thats to come in 30 days time or so which aren't meant to be signed until the car's actually there, and you've agreed thats the one you want, and therefore aren't valid (I.e. they're not legal, so he can't hold you to them).
Either way, I'd say you still technically own your old car. Once again you'd be best to try and get some legal advice, as I'm just making educated guesses here - there most definitely will be something you can do though. Even a 'freebee' lawyer will be able to tell you whether or not you can do something, and if so, what you can do, and the best way to go about it.



How do we get our old car back after trading it?
My mom and me went down to a ford dealer and they are the ones who sold us a ford focus (used). Well anyways we went down there and wanted to trade for a newer kind so we asked for this black one but overnight they sold it. Then we said never mind we'll...
keep are old one. Than he called back and said he had something else for us to look at. So we went back down and he offered this ugly one we didnt taake it of course. Then he offered a brand new 2008 ford focus blue. So he took us outside let us peek in the windows real quick then he took us back inside. Then he convinced us what a nice car it was so we took it. That same day we found a big scratch down the hood. We didnt like how it was a two door because the windows dont go down in the back and thats to dangerous for my little sister. And we are so used to are old used one because the doors had automatic locks. So the same day we went down and said we wanted are old car back because we didnt like it. And the guy said you cant have your old car back. And he said come down saturday and we will find you a four door. we went down saturday and he said theres nothing we can do we have to wait 30 days to see if we could POSSIBLY get another one... Is there a way we can just get are old one back its still sitting down in the lot? Thats all we want... Its not like we are sking for another new one. What can we do? O yah we live in pennsylvania if theres any kind of law or something.
