Yes, look at your purchase contract. There should be a section covering possession. Generally, possession is transferred at closing, although sometimes it is transfered after or even before the closing. This is generally something that is negotiated between the parties.
In your case, it sounds like this was not something negotiated, so it is probably set by a form provision in your contract.
You call and ask your Realtor, that is why they got the commission check at the closing. In every state that I know of, it has to be listed in the closing documents, if you do not see it, call your agent asap. You had prepaids at the closing, I would hate for you to be paying for someone else to live in your home.
