Am I a felon?

Asked by lsh1984 3 months ago, 5 answers.

I was convicetd in a military court in 2003 of a crime that requires me to register as a sex offender. Because of that, I have a hard time getting and keeping jobs. I am currently suspended without pay, till I can prove I am not a convicted felon, and prove that I have not been convicted of a felony.
I have talked to the Office of Military Justice, and the military does not consider me a felon. I even have a voter card for Michigan(state of res.). But the big bosses for my company want me to prove that the state does not consider me a felon and that the charges are not felonies. I need help with this, so if there is anyone who can get me info on this so I can go back to work, please share!!

I would get something in writing from the Office of Military Justice stating that your conviction is not considered a felony by them.

Then I would contact a District Attorney or lawyer in your state to find out what your state's laws state.

Most credible businesses run background checks. I can't think of the name of the service most companies use at the moment, but I'm sure you could look it up.

It's not right of them to suspend you until you prove you're not a felon. They should let you continue to work until THEY CAN prove you ARE a felon.

Get all the documentation that you can stating that you are not a felon, then sue their asses for discriminitation and defamation.

It depends on your sex offense, many are felonies but some are not. You would KNOW if you were a felon.

A 'felon' would suggest that you were convicted of a felony. The crime that you were charged with, found guilty of, court martialed and/or dishonorably discharged for requires that you register yourself. Even if you put on your appication that you were discharged from the military with a less then honorable, the employers will ask why. The Area Defense Council should have explained all of that to you. You can probably have a Memorandum for Record notarized is someone is willing to do so.
